1. Acceptance of These Terms
By accessing or using the Oklahoma's Choice Weekly website or client portal, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the site or portal.
2. Informational and Publication Content
OCW provides local advertising, auctions, classifieds, community information, digital editions, recipes, articles, directories, tributes, and related content. We work to provide useful and accurate information, but dates, prices, availability, descriptions, images, links, and event details can change or may be supplied by advertisers and other third parties.
Verify important information directly with the advertiser, auction company, seller, event organizer, business, public agency, or other original source before traveling, bidding, purchasing, relying on a deadline, or making another decision.
3. Auctions, Classifieds, Advertisements, and Directory Listings
OCW publishes paid and unpaid material supplied by third parties. Unless expressly stated, OCW is not the seller, auctioneer, broker, organizer, manufacturer, employer, or service provider identified in a listing or advertisement. Publication is not an endorsement or guarantee.
Third parties are responsible for their claims, offers, inventory, terms, licenses, safety, legality, and fulfillment. Any transaction or dispute is between you and that third party. Auction terms published by the auctioneer control the sale.
4. Accounts and Client Portal
Client portal access is provided to authorized OCW advertisers. You are responsible for keeping access codes confidential, using the portal only for the account you are authorized to access, and promptly notifying OCW of suspected unauthorized activity.
Portal information is provided for convenience and may not always reflect recent offline changes. An OCW invoice, signed order, insertion order, proposal, or direct written confirmation controls if portal information conflicts with the parties' governing business records.
5. Submissions
When you submit text, photographs, artwork, logos, files, event information, tribute material, advertisements, or other content, you represent that:
- You are authorized to provide the material and request its use.
- The material does not unlawfully infringe copyright, trademark, privacy, publicity, or other rights.
- The information is accurate to the best of your knowledge and is not fraudulent, defamatory, threatening, obscene, or unlawful.
- You have obtained appropriate permission before providing another person's personal information or photograph.
You retain ownership of your material. You grant OCW a nonexclusive, worldwide, royalty-free license to review, edit for format, spelling, clarity, length, and presentation, reproduce, publish, display, distribute, archive, and promote the submitted material in OCW's print, website, digital edition, social media, email, audio, video, and related channels for the purpose requested.
OCW may decline, remove, postpone, correct, or edit submissions in its editorial and business judgment. Submission does not guarantee publication. Unless separately agreed, submitted material may not be returned.
6. Advertising and Payments
Advertising placement, schedules, rates, specifications, proofs, cancellations, credits, and payment obligations are governed by the applicable invoice, order, proposal, rate card, or written agreement. Website descriptions do not replace those terms.
Card payments are processed by Stripe on Stripe's website. Your use of that checkout is subject to Stripe's terms and privacy practices. OCW does not store complete card numbers on this website.
7. Intellectual Property
The site design, OCW name and branding, original articles, graphics, photographs, videos, audio, page layouts, software, and other OCW-created material are owned by or licensed to OCW and are protected by applicable law. Third-party advertisements and submitted materials remain subject to their respective owners' rights.
You may view and share links to public pages for personal, noncommercial use. You may not scrape, republish, sell, alter, frame, systematically download, or commercially exploit site content without written permission from OCW or the applicable rights owner.
8. Acceptable Use
You may not use the site or portal to break the law, gain unauthorized access, impersonate another person or business, introduce malicious code, interfere with site operation, harvest information, send spam, probe security, or submit harmful or deceptive content.
9. Third-Party Services and Links
The site may link to or display content from advertisers, auction platforms, social networks, payment processors, video services, map services, flipbook providers, chat tools, and other third parties. OCW does not control those services and is not responsible for their availability, content, security, or practices. Their terms and policies apply when you use them.
10. Disclaimers
The site and portal are provided on an "as is" and "as available" basis to the fullest extent permitted by law. OCW does not warrant uninterrupted access, error-free operation, complete accuracy, or that every file, link, listing, or third-party service will remain available.
Recipes, health-awareness articles, financial information, legal topics, safety information, and other general-interest content are informational only and are not professional advice. Use appropriate judgment and consult a qualified professional when needed.
11. Limitation of Liability
To the fullest extent permitted by law, OCW and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, inability to use, or reliance on the site, portal, advertisements, listings, submissions, or linked services.
Nothing in these terms excludes liability that cannot legally be excluded. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
12. Suspension and Changes
OCW may restrict or end access to the site or portal when reasonably necessary for security, maintenance, suspected misuse, nonpayment, or protection of OCW or others. We may revise these terms as services change. The date at the top identifies the current version, and continued use after an update means the revised terms apply.
13. Governing Law
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute will be handled in a court with proper jurisdiction in Oklahoma, unless another written agreement or applicable law requires otherwise.
